WhoisGuard Complaint | WhoisGuard Review

During the past few years I have received numerous SPAM emails in which the owners used WhoisGuard to hide their identity.

WhoisGuard has a page on their site to report spam at http://www.whoisguard.com/report-spam.asp and they state the following;

“Some times spammers use WhoisGuard to protect their true identity. We have zero tolerance policy to such behavior. We will try to take the immediate action which may even include terminating the offending domain name if it is under our control”.

On numerous occasions, I have filed spam complaints and they have NEVER removed the privacy on any of the spammer’s I’ve reported.

An argument could be made that they are engaging in false advertising by claiming they have a zero tolerance SPAM policy while failing to remove a spammer’s privacy when abuse is reported to them.

Engaging is false advertisements is a federal crime, according to details at http://law.cornell.edu/uscode/text/15/54 .

It seems that the owners do not care that their service is being abused by criminals.  It appears that they are ignoring all complaints and doing nothing.

Sending SPAM is a Felony Offense Violation of United States Code Title 47, Section 227(a)(2) (B) CAN SPAM laws.  Penalties include up to $250,000 in fines per offense and up to 5 years imprisonment.

An argument could be made that WhoisGuard is aiding and abetting criminals in perpetrating crimes by hiding the criminal’s identity.   This helps embolden internet criminals to do anything they want.  WhoisGuard is preventing those who have been victimized from finding out who victimized them.

An argument could be made that WhoisGuard further victimizes victims by preventing victims from finding out who victimized them leaving them no other recourse but to pursue expensive legal action to COMPEL WhoisGuard to reveal the identity of the person(s) who victimized them.

Most people cannot afford to take legal action to MAKE WhoisGuard to reveal the identity of the person(s) who victimized them.

To be fair, WhoisGuard is not the only company which is protecting the identity of criminals.  There are other unresponsive whois privacy companies and registrars which fail to do anything when abuse is reported to them.

It is amazing that such an unfair situation as this exists and the US Government or ICANN hasn’t done anthing about this to protect US Citizens.

Something needs to be done to rectify this situation ASAP!

Therefore, I may be contacting the directors of ICANN and members of congress involved in ICANN oversight about this matter soon, plus the United States Dept of Justice and my state’s Attorney General.

It’s my opinion that any company which protects the identity of criminals who are breaking the law and fails to remove criminal’s privacy is a menace to  the public and should be shut down.
